1. Introduction
Fraggy respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we have established the following policy to address claims of copyright infringement on our website (fraggy.app) and services (collectively, the "Service").
Fraggy is owned and operated by Synost, which is responsible for responding to notices of alleged copyright infringement.
2. Reporting Copyright Infringement
If you are a copyright owner or authorized to act on behalf of a copyright owner and believe that any content on our Service infringes your copyright, you have the following options to submit a DMCA Notice:
Option 1: Direct Report on Clip Page
For the quickest resolution, you can report copyright infringement directly from the clip page:
- Navigate to the specific clip that contains the infringing content
- Click on the three dots menu (⋯) in the clip's action bar
- Select "Report" from the dropdown menu
- Choose "Copyright Infringement" as the reason for reporting
- Provide additional details about your copyright claim in the text field
- Submit your report
Option 2: Email Submission
Alternatively, you can send a complete DMCA Notice to our designated copyright agent containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL of the specific clip or content);
- Your contact information, including your address, telephone number, and an email address;
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification Procedure
If your content was removed due to a DMCA notice and you believe this was done in error, you can submit a counter-notification.
To submit a counter-notification, email dmca@fraggy.app with:
- Your contact information (name, email, phone number)
- Identification of the content that was removed
- A statement explaining why you believe the content should not have been removed
- Your consent to legal jurisdiction and service of process
After we receive your valid counter-notification, we'll forward it to the original complainant. If they don't take legal action within 10-14 business days, we may restore the removed content.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
